187 refusal- not genuine position

I note that the Regional Certifying Body (RCB), Chamber of Commerce and Industry,
…  has advised that this criterion is satisfied on a …….according to their
assessment, and I place some weight on this assessment. It is my role as a delegate of the
Minister to independently (of the RCB) consider whether the business has demonstrated a
genuine need to employ a paid employee to work in the nominated position under the direct
control of the business….- NICE – Some weight

The documents provided with the application that are labelled ‘evidence of genuine position’
contain delivery ………………………. and I find these documents are not relevant to
this regulation. – VERY IMPORTANT SECTION AND MUST BE CONSIDERED CAREFULLY, more than better.

I have considered the organisational chart……- The applicant has not provided supporting evidence to demonstrate that the position identified in the organisational
chart is required to support the existing business or will support the business moving forward. – MANAGERIAL POSITION BEING HEAD OF A BUSINESS IS NOT ENOUGH EVIDENCE IN ORGANISATION CHART?
